Man Charged With BTC Purchase of Firearm and Silencer on “Darknet”

BOSTON – A Hyannis man was charged today in federal court with purchasing a firearm and silencer on a “Darknet Market” website, which provides anonymity to users to buy and sell illegal goods.

Justin Moreira, 21, was arrested today and charged in a criminal complaint with one count of being a felon in possession of the firearm and silencer.  According to court documents, Moreira has a previous felony conviction in Barnstable County in 2013 for possession of a controlled substance with intent to distribute.

As alleged in the criminal complaint, a Darknet Market website is an online market that operates outside the parameters of the traditional Internet, allowing individuals anonymity to buy and sell illegal items, such as firearms and drugs.  Such transactions are often conducted for bitcoins.  The complaint alleges that beginning in January 2015, Moreira engaged a federal undercover agent in a series of online messages during which Moreira inquired about the potential purchase of several different firearms.  Ultimately, Moreira allegedly ordered a Walther PPK/S .380 caliber pistol and silencer from the agent for which he paid the equivalent of $2,500 in Bitcoins.  Moreira instructed the agent to ship the package to a Post Office box in Hyannis.  Federal agents monitoring the Post office box immediately arrested Moreira after he retrieved the package this morning.

The charging statute provides for a sentence of no greater than 10 years in prison, three years of supervised release, and a fine of $250,000.  Actual sentences for federal crimes are typically less than the maximum penalties.  Sentences are imposed by a federal district court judge based upon the U.S. Sentencing Guidelines and other statutory factors.

Kumor, Special Agent in Charge of the Bureau of Alcohol, Tobacco, Firearms & Explosives, Boston Field Division; Shelly Binkowski, Inspector in Charge of the U.S. Postal Inspection Service; Bruce M. Foucart, Special Agent in Charge of Homeland Security Investigations in Boston; Colonel Timothy P. Alben, Superintendent of the Massachusetts State Police; and Barnstable Police Chief Paul MacDonald, made the announcement today.  The case is being prosecuted by Assistant U.S. Attorney Mary B. Murrane of Ortiz’s Major Crimes Unit.

The details contained in the complaint are allegations.  The defendant is presumed innocent unless and until proven guilty beyond a reasonable doubt in a court of law.

    Yes man… darknet is safe, people isn’t.

    • The reason why he was charged in the first place was because he bought a gun illegally. You need a FFL or Federal Firearm license, to be able to sell guns. In the USA if one were to sell there own guns this is illegal, unless you get some documentation and have some licensed individual that can permit the sale. In some states you cannot do this they won’t allow you to sell with out an FFL. In other states it’s a problem but none the less to buy a gun such as this you will need to go to a dealer to get it.

      The other issue is the silencer he bought which is legal in 39 states. But to get it you need to submit an ID and finger prints to the ATF followed by a $200.00 tax that you need to give them. The entire process could take 10 months to get one. Lastly he as a felony which makes it illegal to own weapons.

      The mistake that cost him was all cops will ask you again to make sure you want to do this. I seen it all the times, you ask you want someone dead and after talking and negotiations. They’ll ask you “Are you sure”?. A person that needs money that badly will not ask this. This agent didn’t respond to him in 2 weeks, at this point I would of been worried on top of that his feedback and most likely he didn’t have any vouches. I would of been pisses, the agent asks “Do you still want it”?. Always giving the choice to back out and he should of said I want my refund I changed my mind, what kind of vendor will ask are you sure? if you’re a scam you’re gone after 2 weeks come on lol.

  4. It is another indication that if you are guilty of a non-violent drug possession charge, and/or many other non-violent crime, the feds will be on your ass for the rest of your life. Tyranny and oppression are readily available in our country, and we are forced to pay for it. We the people, are a resource that the US government uses to achieve its goals and ambitions around the world under the guise of freedom, liberty, and democracy. It is a good thing that we can speak freely and not be hassled by the government for doing so, isn’t it?
